All content (text, images, logos, design) on the Website is owned or licensed by Modello Construction and is protected by copyright, trademark, or other intellectual property laws.
You may view, download, or print pages for your personal, non-commercial use.
You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.
You must not use the Website for unlawful or prohibited purposes.
3. Service Proposals, Contracts & Estimates
Any proposal, quote, or estimate provided is non-binding until a formal written contract is signed.

4. Payments & Billing

Late payments may incur interest or suspension of work until you bring your account current.
You are responsible for additional costs (permitting, inspections, site access, etc.) unless otherwise stated.
5. Client Obligations
You agree to:
Provide accurate project information, drawings, and access to site
Obtain any required approvals, permits, or easements (unless included as part of our scope)
Communicate issues or changes promptly
Provide timely feedback and decisions
Ensure a safe, clean, and accessible site (except where we have responsibility per contract)
6. Warranties & Disclaimers
We warrant that our work will be performed in a professional and workmanlike manner, consistent with industry standards.
Our warranty does not cover damage from misuse, neglect, acts of God, or unauthorized modifications.
The Website and content are provided “as is”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
7. Limitation of Liability
To the fullest extent permitted by law, Modello Construction is not liable for:
Indirect, incidental, special, punitive, or consequential damages
Loss of profits, revenue, data, or business interruption
Costs resulting from delays, defects, errors, or omissions, except to the extent of our indemnity obligations as defined in the contract
Our total aggregate liability under or relating to these Terms or the contract shall not exceed the total amount you have paid us.
8. Indemnification
You agree to indemnify, defend, and hold us, our officers, directors, employees, agents, subcontractors, and affiliates harmless from any claims, liabilities, losses, damages, or expenses (including reasonable attorney’s fees) arising out of or related to:
Your breach of these Terms
Your negligence or willful misconduct
Inaccurate or incomplete project information you provided
Violations of applicable laws or third-party rights
9. Termination / Suspension
We may suspend or terminate work or services if you fail to pay invoices, breach contract terms, or interfere with project progress.
You may terminate subject to contract terms (e.g. notice period, payment of work performed to date).
Upon termination, you pay for all work completed, materials procured, and costs incurred to the date of termination.
10. Dispute Resolution & Governing Law
These Terms and any contract shall be governed by the laws of the State of Texas (or whichever jurisdiction your business is in).
Any disputes shall first be attempted to resolve via good-faith negotiation or mediation.
If unresolved, disputes may be brought in the courts of [appropriate county / jurisdiction].
11. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be struck, and the remaining provisions will remain in full force and effect.
12. Changes to Terms
